Deed

This Indenture made the first day of December in the year of our Lord one thousand eight hundred and eight between William Deputy Senior of the County of Sussex and the State of Delaware of the one part and the Heirs of Jesse Deputy late of the County and State aforesaid, deceased, of the other part, namely James Deputy, Mary the wife of William Truitt, Abraham Deputy, Zachariah Deputy, Jesse Deputy and Silvester Deputy
Whereas Silvester Deputy father to the said William Deputy and Jesse Deputy the elder, deceased was seized and possessed of certain land and tenements situate in the County of Sussex and State aforesaid, and being so thereof seized, departed this life intestate, leaving five sons and six daughters to whom the said lands and tenements descended
And the said William Deputy after the death of the said Silvester Deputy his father, purchased of Solomon Deputy, eldest son of the said Silvester Deputy dec'd, all his rights and claim in the land aforesaid and hereby became the Representative of the eldest brother and conformed to the intestate laws of the State aforesaid, in such case is made and proved became the owner of the lands and premises aforesaid but nevertheless a division was made in the lands and premises aforesaid amongst the heirs of the said Silvester Deputy dec'd, by permission of the said William Deputy as appears by a certain Bond or Obligatory Contract, duly executed by him the said William Deputy in and by which said agreement or bond aforesaid, the said William Deputy was to convey unto the said Jesse Deputy, his heirs or assigns, a certain part of the intestate lands of the said Silvester Deputy deceased, as by said Bond, appears but no Deed of Confirmation was ever made to the said Jesse Deputy in his lifetime
And the said William Deputy was being willing to comply with his former contract by making a Deed of Confirmation to the heirs of said Jesse Deputy deceased, for such lands as was, tract for the aforesaid Bond or Obligatory Contract. Therefore this Indenture witnesseth
That the said William Deputy for and in consideration of the sum of seventy five dollars to him in hand paid by the said Jesse Deputy in his life time, and also for an in consideration of the sum of five shillings to him in hand paid by the said Heirs of Jesse Deputy deceased
HATH granted, bargained, sold, aliened, remised, released, enfeoffed, conveyed and confirmed and by these presents DOTH grant, bargain, sell, alien, remise, release, enfeoff, convey and confirm unto the said Jesse Deputy's Heirs who is above named and to their heirs and assigns forever, all the said piece, parcel or tract of land described in the said Bond or Obligatory Contract, for, in the life time of the said Jesse Deputy, together with all and singular the improvements and appurtenances, thereto belonging or in any wise appertaining, To have and to hold the same unto the said Jesse Deputy's heirs and to their heirs and assigns forever
And the said William Deputy for himself, his heirs, executors and administrators do agree to and with the aforesaid heirs of the said Jesse Deputy, deceased, that he the said William Deputy, the hereby granted premises with all the appertenances unto the said Heirs of the said Jesse Deputy, deceased, and to their heirs and assigns forever, against the claim of him the said William Deputy and his heirs and against the claim of all and every other person or persons whatsoever lawfully claiming or hereafter to claim the same, shall and will Warrant and forever defend by these presents
